The New Public Charge Guidance Will Go Into Effect On December 23, 2022.


The Biden Administration published a Notice of Proposed Rulemaking (NPRM) for a public charge rule on February 24 ,2022.

The Biden Administration has proposed a public charge rule. Public Comments on the proposal are due April 25, 2022. On March 2, 2022, PIF-IL hosted a webinar sharing information on what is in the proposed rule and how organizations can engage in the rulemaking process.


As of March 9, 2021 the 1999 public charge guidance is in effect.
